Services as stated in the T&C section of FLYTOPS cover planning a travel, consultation, charters, yachts, airfares, information about cruise, hotels, camps, resorts, tours, leisure, adventure activities, car rentals, renting the equipment’s, etc. all these services whether offered, recommended, provided or sold by FLYTOPS. Some of the common terms that you will discover in the section below with their exact meanings:
Trip: Any service or package that encompasses multiple services will be referred as Trip. Anyone providing these services will be referred as Supplier or Vendor. Any personalized schedule of a trip will be recited as Itinerary. The buyers or travelers who invest in the services or attempt to show interest in the services by FLYTOPS will be referred as You or Yours.
Any kind of Bookings that is done in association with FLYTOPS are subject to the Terms and Conditions of the Vendor.
When you purchase a service or a package of services from buyers, you consent to put-up-with the T&C of the vendor without stipulation. If you find a clash between the T&C of the vendor and FLYTOPS, it will be the responsibility of FLYTOPS to resolve the issues and settle the liabilities, abiding by the ethics of the company.
Below mentioned are the Terms and Conditions of FLYTOPS. Please read them carefully and feel free to call at out toll free number in case of any inquiries. Before clicking on the box of “I Agree” it is recommended to go through all the T&C as you approve to accept them all. On buying the services for someone other than you, you consent to share the T&C with the travelers availing the services. The travelers will be bound to operate as per the clauses mentioned in Terms and Conditions. Without agreeing to the section, you will not be directed any further in the booking process.

The Services offered by FLYTOPS are available for purchase by residents of the United States while in the United States, its territories, possessions, and protectorates, who have all the requisite power and authority to enter into and perform the obligations under these Terms and Conditions. Travelers must be over the age of 18 to purchase a FLYTOPS Trip.
We own all the rights to make changes in our T&C section without any prior notice on the acknowledgement that the changes don’t affect the prior bookings with FLYTOPS It is thus recommended to go through the terms and conditions every time you avail our services or before making a booking with us. This will also help you in assimilating about the latest changes that we have made and the advantages we have added for the customers. Once the service by FLYTOPS is activated and brought, no claim on the money will be entertained unless it will be mentioned in the description of the package. Following of the charges will not be included:

There is a contrast between our cancellation services as they vary from the service or package of services that are sold. You can find all the information about the cancellation incorporated with the service. In the course of any missing information on the context, you can contact our customer service executives at the time of purchase or prior.
Amendments Bestowed to FLYTOPS:
Due to environmental changes like weather conditions or as a result of political changes, we are free to reschedule the routes and timings of flights. It is beyond our control and we can occasionally cancel bookings. While we try not to cancel bookings or any modifications, but we have the right to do this before prior notice. Some changes are minor which doesn’t affect but some changes are big which cannot be avoided. Bigger changes include a change which is done before departure of the flight taking into account your information which has been provided to us at the time of booking. These changes can take into account your accommodation, travel places, departure timings etc. wherein your accommodation can be shifted to a lower standard when you are not there, your travel place can be changed, departure timings can vary or departure place can be changed to one which is convenient for you to reach and this would be done where your trip would be organized by us.
In case of significant changes, prior information will be provided from our end as soon as possible. In this case, we would be providing you alternate routes options or dates to suit you and to our concern, we will offer you a package of similar cost and standard. If there is some time in your departure, we would like to offer you some choices:
You can accept the changed schedule.
You can exchange your trip with your previous one but of similar standard. It would be a nice offering from us that you will have an option to select alternate trip and for that you don’t need to pay any extra fees. And if in case you’re new trip costs less than the original one, we will refund the extra amount promptly. In case, you don’t like the trip offered by us, you can refuse to take it and choose from other available arrangements. And you have to pay for such arrangements which imply that you have to pay the extra amount for a package which is not offered by us and refund will be paid by us if your package costs less than the original.
You can cancel the trip for which we are entitled to pay full refund on the paid amount.
All the above mentioned points are not applicable for minor changes and for significant changes; your queries would be entertained by us for which you will receive compensations and refunds if we owe any. Everything depends upon the situations and under some circumstances we are not liable to pay you anything. Exceptions are always there, please note:
No compensation will be given to anyone if we are forced to make any changes in the flights. It can occur as a result of unforeseeable and unpredictable circumstances which are out of our control. And for all those situations where we are helpless or could not avoid the situation even after full care and attention.
Furthermore, no refunds or compensations will be entertained if there is any fraud from your side or you fail to comply with our policies or booking conditions. In this case we have to cancel the flight without any notice and you will not get any refunds.
We may need to cancel the flight after your departure and before the end of your trip under “force majeure”. If this situation arises, we are sorry to say but we cannot promise you refunds unless we get it from our suppliers. No compensation will be paid or any costs or expenses made by you from your own and this happens in rare situations.
Important: All packages including air tickets or vacations would be non-refundable. Refund requests will be taken only if the below conditions are met.
If the rules provide for refunds.
If we get the refund from our suppliers only then we will process your refund requests.
Once when you submit your refund request, an e-mail will be sent to you to inform that your request has been taken by our customer service agent. It doesn’t mean that you qualify for refunds. First of all, we will check your request for possible fare rules with the airlines. Then if the airlines allow for refunds, your request will be entertained and refund will be generated. It can take up to 4-6 weeks for the refunds to be transferred to you.
CHANGES AFTER PURCHASE: Any change made after your purchase is restricted. Flight timings can change subject to availability. And difference in the cost of original price and lowest price of new flight is made.
If any cancellations are made then the cost will be given by our suppliers. If you cancel any flight, you cannot escape from paying the sum that you need to pay to FLYTOPS. If you don’t stay in the place where you ought to or stay for shorter duration, we don’t owe you any refunds for this. Whatever the reason is, if you fail to enjoy the services, you will not get any refund.
Cancellation charges are applied on alterations made by you or if you go for new bookings by cancelling the previous booking. Such charges will be notified before any alteration is made.
Travel documents: Travel documents and tickets are issued only to those travelers who place the order and abide by the terms and conditions. FLYTOPS is not responsible if trip is affected due to your carelessness on the receipt of travel documents. Basically, documents and tickets are issued between the date of issue of tickets and date of departure.
Insurance: FLYTOPS suggests you to purchase some insurance like travel, cancellations, medical emergency or lost luggage for every trip. We refer you to respected insurance company and it is your responsibility to clearly understand the limitations and coverage of the insurance. You need to research and analyze the insurance offer by yourself and you cannot hold us responsible for any losses.
Travel Risks, Passports, Visas and Health Needs: Before travelling, you should check all the necessary documents required like visa, passport or any other things. If you are travelling outside the country, you must have your valid passport, visa, certificates and permits if any and medical certificates with you.
International trips do require passport and visa valid at least for 6 months. People who are not the citizens should contact consular office to know about the requirements about the trip.
Having no visa with you where it is required can leave you in prison until you don’t get any flight to get back to your origin. India asks for tourist visa to allow you to visit.
It is a law of some countries that you must have a return ticket and sufficient funds to show. And some countries require insurance evidence or coverage before issuing the visa.
Before planning your travel, you must consider all the points and formalities and make sure that your personal information like name, address, gender should match with the information on your passport and travel documents.

Before traveling, you must obtain the necessary information of that particular country from respective departments. Local health departments provide up-to-date information. It’s your responsibility to check the vaccination of each destination and other safety measures.
You are responsible to carry correct information and valid documents required for the country where you are traveling. Any necessary medication, vaccination is your responsibility and we are not responsible for your illness, claims and compensations if you don’t meet these criteria.
WE ARE NOT RESPONSIBLE IF YOU FAIL TO TRAVEL FOR NOT CARRYING YOUR DOCUMENTS OR PASSPORTS. YOU WOULD BE HELD RESPONSIBLE FOR PAYING ANY SURCHARGES OR FINES IF YOU DON’T MEET THE CRITERIA AND ANY PENALTIES WOULD BE ENTERTAINED BY YOU AND WE SHALL NOT BE BLAMED.
FLYTOPS is not responsible if you get stuck in some situation at the destination as some areas are risky. So you will be traveling at your own risk and we don’t take any guarantee for any mishaps. We don’t reserve the right to gather information about your travel destination.
IF WE ARE PLANNING OR ARRANGING TRIPS FOR YOU, WE ARE NOT ENTITLED TO GIVE YOU ANY SUGGESTIONS RELATED TO RISKS AND SECURITY ISSUES OF THAT COUNTRY. WE WOULD NOT BE LIABLE FOR ANY LOSSES OR DAMAGES CAUSED TO YOU UNDER ANY CIRCUMSTANCES.
FLYTOPS is not responsible for the accommodations provided to you as they are booked through third party vendors. Location, amenities are not guaranteed by us and we have no ownership on the accommodations. It can be any lodge, hotels, resort, quarters or anything to camp grounds as well. FLYTOPS is not responsible for the performance of third party vendors and if any problem arises, you can contact the accommodation’s owner directly on you end.
All the accommodations are for double sharing and if you want to use it on single basis, then you might need to pay some extra fee for that as single accommodations are little expensive than those compared with double ones. You can contact us to know about the supplement fee for single sharing.
Customs and Laws: Every country has different laws and customs. Every traveler traveling to different countries with diverse culture and religions should make sure that he can come across some weird situations. And FLYTOPS is not responsible for any such situation. He or she must cope with the situations on their own and should not blame us. We only plan your trip and don’t take any guarantee of your problems while your trip. All the travelers should abide by the local laws and regulations to avoid such situations and it is better to maintain some distance from the local residents. FLYTOPS is not responsible for damages, losses or any overhead expenses incurred by you if you fail to obey the rules.
Follow Conduct and Legal Rules: Any traveler can be terminated if his behavior is inappropriate or undisciplined. FLYTOPS reserves the right to cancel any trip if we feel that your behavior is incompatible with the employees or other travelers. And in this case, you have to pay for alternate trip and accommodations.
Not all the information showed at our site may be correct as it comes for various sources and vendors. Newsletters, brochures, restaurants, hotels, clubs showed in the advertisements may vary as they are only for that purpose and you shall not hold us responsible for this. So before booking any trip, you should do some research or investigation on the information provided at our site. Research is needed to make sure that your requirements are fully fulfilled at our site.
FLYTOPS makes use of your photographs or images in the promotional events or advertisements and you consent to such usage by us. You cannot ask for compensations or rewards in return as it is solely for marketing purpose.
Not Responsible for Liability: FLYTOPS WOULD NOT BE RESPONSIBLE FOR ANY DAMAGES WHETHER IT IS INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL. IN NO EVENT SHALL FLYTOPS WOULD BE PAYABLE TO THE TRAVELER EXCEEDING THE AMOUNT PAID BY HIM FOR TRAVEL.
FLYTOPS WORKS WITH THIRD PARTY AGENTS OR VENDORS FOR TRAVEL BOOKING INCLUDING TICKETS AND ACCOMMODATION AND WE TAKE NO RESPONSIBILITY OF THOSE VENDORS. WE ARE NOT LIABLE FOR ANY PERSON’S DEATH, INJURY OR ANY DAMAGE CAUSED DUE TO ANY REASON OR VIOLATION OF VENDOR’S POLICIES.
DISCLAIMER OF WARRANTIES: FLYTOPS OFFERS GOODS AND SERVICES TO YOU IF AVAILABLE AND WE ARE NOT LIABLE TO PROVIDE YOU GOODS IF THEY ARE NOT AVAILABLE WITH US.
Release and Indemnification: FLYTOPS would not be responsible for any liabilities, claims, losses, expenses, damages or any other activity which is caused due to traveler’s carelessness or service provider mistake or any other third party. We would not take any liability of any kind under any circumstances in a trip. It is the responsibility of the traveler to not to hold us responsible for you damages while your trip and you should defend us in every possible manner and set us free from all the expenses and damages, or any claims against us.
Force Majeure: FLYTOPS is not responsible for any situation which arises under severe conditions or which is beyond our control. Force majeure means that some situations are not under control and we have to take some necessary steps arising out of that conditions like cancellation or postponing a flight or anything related to travel. Conditions on which we don’t have any control can include earthquakes, tsunamis, floods, mudslides, war, security alerts, labor disputes, disease breakdown or anything like natural calamities. In such cases, we cannot take guarantee of your refunds and you cannot claim your money from FLYTOPS as we have full right to cancel or postpone any flight under Force Majeure.
AIR TRANSPORT: We only book flights through our suppliers or third party vendors and we are unaware of all the airlines carriage systems or aircrafts so we cannot keep you notified about all the things and our advertisements or brochures can display information different from the airlines, so FLYTOPS should not hold responsible if any vendor changes the flight timings, re-schedule your trip, change your seats and type of aircraft, cancel the flight. If this happens, you should contact your respective airlines to get full information about the flight and ensure that you reach at your destination on time or before time. FLYTOPS will not pay any amount if you miss your trip by any means or suffer any other problems while traveling or if your boarding is denied due to missing documents.
If you are traveling in stop-over flights and you have booked two flights, it’s your responsibility to check whether you would be able to reach the second airport on time or not. FLYTOPS will not suggest anything related to this and you should check that you have enough time to board on the second airport and this is the case for connecting flights. All the expenses to reach the second airport will be incurred by you and we will not pay a single penny and if in case you miss the second flight, no refunds will be made.
FLYTOPS would not pay any amount or claims due to cancellations, delays or changes in the flights. If you fail to check in or board your flight due to your mistake or any health formalities, we would not be liable for this.
Problems related to e-tickets: IATA has made a rule to issue e-tickets for every booking. But due to technical issues, babies under the age of 2 may not get e-ticket and if this situation occurs, we would not be able to reserve your booking. This situation is beyond our control and we are not liable for anything. We can suggest you alternate routes and if you choose to do so, it is okay and if not, then we have to cancel your booking forcefully for which you will get your refund within 30 days.
Check-in problem: If you fail to check-in on time under any circumstances, your flight will be canceled automatically by the airline. And if you have return flight as well, we recommend you to contact us on the day of departure to keep that flight open.
Connecting flights: If your connected flight is cancelled by any means, then airlines will arrange for your transport in some other means like bus or train. And if you yourself are arranging this connecting transport, always go for refundable tickets which will keep you away from financial losses.
Return: It is your duty to check your return ticket with local airlines 72 hours before your departure. If you have purchased the ticket through any agent then this responsibility lies with him. And if in case you don’t get it confirmed, airlines can give your seat to someone else. This is mandatory because you will know the timings of the flight that may have been modified by some means.
Luggage and Baggage: If your luggage is lost or damaged in transit, airlines will not pay for any of this type of loss. Airlines will also be responsible for that luggage which is kept with them under international conventions and not any other type of luggage loss will be entertained by airlines. If you find your luggage lost then you must submit a declaration form (including the originals of travel ticket, check-in slip of luggage) of your damage and loss to the respected airlines but all this needs to be done before leaving the airport.
Kids and babies: Babies of 2 years don’t need a separate seat and their ticket is 10% of the original ticket and for kids from 2-11 years of age may get some reduction in ticket charges.
Medical and Physical Conditions: We offer some trips which include activities like skiing, surfing, diving etc. which needs your health to be perfectly fine. So you being a traveler should not take anything which can harm your health on trip and if any mishap occurs, FLYTOPS would not be responsible for this. Activities like skiing, surfing needs your heart and mind to be stable and strong to perform them and if you are not properly fit to carry on these activities then we would recommend you not to perform as for any mishap we would not be responsible.
Traveler will be responsible for taking care of his health whether mental or physical or any other conditions. If any serious issue occurs,FLYTOPS don’t take any responsibility for this and it is possible that a physician attends you but we will not pay for any such treatment and you will have to pay on your own expense. And if anything happens to you, we are not liable.
Entire Agreement: All these terms and conditions comprise the mutual understanding of both the parties i.e. FLYTOPS and traveler. FLYTOPS takes no guarantee that action will be taken if any one violates these terms and conditions and no waiver or modifications will be made under any provision unless these terms and conditions are not signed by both the parties.
